Declaration of no civil judgment: in what cases, and how does it work?

Certain processes — obtaining a position of trust, a licence, financing — require a person to declare under oath that no civil judgment (unpaid debt, lost lawsuit) has been rendered against them, or to detail one if it has.

This declaration does not replace a formal search of the court record when one is required — it instead lets the organization rely on a direct confirmation from the person concerned.

In what situations is it requested?

  • a position of trust or one involving financial responsibility;
  • a professional licence or permit application;
  • an application for significant financing or credit;
  • a bidding process requiring confirmation of good commercial standing.

What should the declaration contain?

  • the declarant's full identity;
  • confirmation that no civil judgment has been rendered against them, or details of any existing judgment;
  • a statement of truthfulness.

Does it need to be sworn?

This depends on the receiving organization. Always check its exact requirements before having your declaration sworn.
