SJ-1098 — Application to the court in civil matters: online oath commissioning

Form SJ-1098 from Québec's Ministère de la Justice requires a declaration under oath. Here is what matters before you have it sworn.

Form SJ-1098, “Application to the Court in Civil Matters,” is used to bring an application to the Court in an already-open civil file (e.g. amending a conclusion, requesting a delay, an adjournment, or any other measure).

The form includes a “Declaration under Oath” section: the applicant attests that the facts alleged in support of the application are true, to the best of their knowledge.

The oath, in brief

Form SJ-1098 contains a declaration under oath (or a solemn affirmation): it must be signed before a person legally authorized to receive it — a Commissioner for Oaths, notary, lawyer, clerk, or justice of the peace.

In Québec, a Commissioner for Oaths can administer this oath remotely, by videoconference, when the required conditions are met (seeing and hearing each other, viewing the document, keeping it confidential).
