Form IMM 5409, “Statutory Declaration of Common-Law Union,” lets two partners formally declare that they have lived in a common-law relationship for at least 12 consecutive months.
It is frequently required for family sponsorship, permanent residence, or visa applications, when the common-law partner of a sponsor or a principal applicant must confirm the relationship. The form is completed by hand, signed before the authorized person, and then attached to the application.
The oath, in brief
Form IMM 5409 contains a declaration under oath or a solemn declaration: it must be signed before a person legally authorized to receive it — a Commissioner for Oaths, notary, lawyer, or justice of the peace. Once sworn, the declaration has the same weight as a statement made before a court.
In Québec, a Commissioner for Oaths can administer this oath remotely, by videoconference, when the required conditions are met (seeing and hearing each other, viewing the document, keeping it confidential).
