Form IMM 5519, “Statutory Declaration of Severance of a Common-Law Union,” is the reverse counterpart of form IMM 5409: it lets a person formally declare that their common-law relationship has ended.
It is required, in particular, when an earlier immigration or sponsorship application referred to a common-law partner and the relationship has since ended — for example, to update a file or start a new sponsorship application. The form is completed by hand and signed before the person authorized to receive the declaration.
The oath, in brief
Form IMM 5519 contains a declaration under oath or a solemn declaration: it must be signed before a person legally authorized to receive it — a Commissioner for Oaths, notary, lawyer, or justice of the peace. Once sworn, the declaration has the same weight as a statement made before a court.
In Québec, a Commissioner for Oaths can administer this oath remotely, by videoconference, when the required conditions are met (seeing and hearing each other, viewing the document, keeping it confidential).
