Form IRM 0005 is part of IRCC’s reconciliation efforts, in response to Call to Action No. 17 of the Truth and Reconciliation Commission.
It lets Indigenous people — including residential school survivors and their families — reclaim their Indigenous name on their identity documents, when they cannot amend their birth certificate or obtain a legal change-of-name document. The declaration must be made under oath before an authorized person.
The oath, in brief
Form IRM 0005 contains a declaration under oath or a solemn declaration: it must be signed before a person legally authorized to receive it — a Commissioner for Oaths, notary, lawyer, or justice of the peace. Once sworn, the declaration has the same weight as a statement made before a court.
In Québec, a Commissioner for Oaths can administer this oath remotely, by videoconference, when the required conditions are met (seeing and hearing each other, viewing the document, keeping it confidential).
