The foreign death record, its translation and its recognition follow their own rules: this declaration supports them, never replaces them.
In what situations is it requested?
- settling an estate or insurance after a death abroad;
- a foreign death record that is disputed, incomplete or hard to obtain;
- dealings with a bank, organization or notary in Québec;
- confirming the relationship with the deceased.
What should the declaration contain?
- your identity and your relationship to the deceased;
- the date, place and known circumstances of the death;
- the documents available (foreign record, translation) and those missing;
- the steps already taken to obtain them;
- a statement of truthfulness.
How does this relate to proof of civil status?
When the death record itself cannot be found or accessed, the process overlaps with the one described in our article on reconstructing proof of civil status.
Declaration to reconstruct proof of civil status
Can it be sworn online?
Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
Online oath commissioning in Québec: how does it work?
Assermentation Express
Assermentation Express is not the Directeur de l'état civil, a foreign authority or a notary and neither issues nor certifies any death record. This service is limited to receiving the oath or solemn affirmation on a document already prepared.
