Declaration relating to a marriage or civil union contract: in what cases, and how does it work?

A notarized marriage or civil union contract determines the matrimonial regime applicable between spouses. When this contract must be confirmed to a third party — a financial institution, a court, a foreign organization — without the original notarial document being directly accessible, a sworn declaration can support that confirmation.

This declaration never replaces the notarial contract itself — a notary remains the only reliable source for obtaining an official copy. It serves to confirm certain facts when the original is not immediately accessible.

In what situations is it requested?

  • confirming the applicable matrimonial regime for a financial transaction;
  • a judicial proceeding where the existence of a marriage contract must be established;
  • a process with a foreign organization that does not recognize the Québec notarial format;
  • a situation where the original contract is not immediately available.

What should the declaration contain?

  • the identity of both spouses;
  • the date and, if possible, the name of the notary who received the contract;
  • the specific facts the declaration is meant to confirm;
  • a statement of truthfulness.

Where do you obtain an official copy of the contract?

An official copy of a marriage or civil union contract is obtained from the notary who received it, or from the Chambre des notaires du Québec if that notary no longer practises. This declaration does not replace that process when an official copy is required.
