Sworn declaration of marital status for retirement benefits: how does it work?

Several pension plans — public and private — determine eligibility for a survivor or spousal benefit based on marital status at the time of death or application. When this status cannot be established otherwise, a sworn declaration may be required.

In what situations is it requested?

  • a survivor benefit application as a married, civil union, or common-law spouse;
  • confirming the length of the conjugal relationship to establish eligibility;
  • the absence of an eligible spouse, when relevant to benefit distribution;
  • verification by the plan when the declared marital status is in question.

What should the declaration contain?

  • the declarant's identity and the spouse's, if applicable;
  • the nature and length of the conjugal relationship;
  • the facts relevant to the eligibility claimed;
  • a statement of truthfulness.
