Declaration to claim unclaimed property: how does it work?

Dormant accounts, refunds never cashed, sums owed to a deceased relative: some property goes unclaimed for years. To recover it, the organization holding it may require a sworn declaration confirming your identity and your right to the funds.

Requirements vary depending on the organization holding the property (financial institution, public body, etc.): always check with it the exact form of proof required.

In what situations is it requested?

  • claiming an inactive bank account in your name;
  • claiming sums owed to a deceased person, as an heir;
  • recovering a refund or deposit that was never cashed;
  • proof of identity when the usual documents are lost or expired.

What should the declaration contain?

  • your full identity and current contact details;
  • a description of the property or sum and the organization concerned;
  • the basis of your right (holder, heir, rightful claimant);
  • a statement of truthfulness.

What if the holder has died?

An heir must generally demonstrate their capacity through other documents (death certificate, will or proof of devolution). The sworn declaration supports these documents without replacing them.
