Sworn declaration of no remarriage: in what cases, and how does it work?

Several benefits — a survivor pension, spousal support, estate benefits — end or change if the beneficiary remarries. A declaration of no remarriage confirms, under oath, that this situation has not changed.

This declaration often complements a declaration of single status in cases where the person has previously been married — the distinction is that single status concerns the absence of any marriage, while no remarriage concerns the absence of a NEW marriage after a divorce or widowhood.

Sworn declaration of single status: in what cases, and how does it work?

In what situations is it requested?

  • maintaining a survivor pension or annuity conditional on marital status;
  • continuing spousal support conditional on no remarriage;
  • an estate process where current marital status affects rights;
  • a requirement from a foreign organization or country.

What should the declaration contain?

  • the declarant's full identity;
  • confirmation of the divorce or death of the previous spouse;
  • confirmation that no new marriage has taken place since;
  • a statement of truthfulness.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
