Sworn declaration for a pharmacy purchase (Ordre des pharmaciens): how to have it sworn?

When a pharmacy is bought or sold, the Ordre des pharmaciens du Québec (OPQ) asks the selling and buying pharmacists for a sworn declaration before updating its registers.

According to the cover letter of the OPQ form, the buying pharmacist must complete the sworn declaration and return the sworn original to the Order (Service de l'inscription) no later than the date of taking possession of the pharmacy, within the meaning of section 32 of the Pharmacy Act.

Who must make a declaration?

  • the buying pharmacist or pharmacists;
  • the selling pharmacist or pharmacists — the Order states it waits for both declarations before completing the registration;
  • each pharmacist-owner, who must sign in the presence of a commissioner for oaths.

Who receives the oath?

The form states that the declarations must be supported by an oath before a commissioner for oaths, who legibly writes their name and residence. The solemn oath section also lists other authorized persons (for example a notary or a lawyer); follow the instructions of the version of the form the OPQ gives you.

What other documents go with the declaration?

The OPQ letter also asks for a copy of the lease for the pharmacy premises (with any assignment or rights-transfer agreements) or a title deed. It finally mentions a separate form to return to the RAMQ within the 48 business hours before the purchase. Confirm these requirements with the OPQ, as they may change.

Can it be sworn online?

Yes, when the situation is eligible for remote oath commissioning by videoconference. Confirm with the OPQ that it accepts an original sworn remotely before booking your appointment.
