Declaration of cessation of business activities: how does it work?

Closing a business involves official steps, but some creditors, insurers, suppliers or financial institutions also ask for a sworn declaration confirming that activities have actually ceased, and on what date.

This declaration does not replace any official step with the relevant authorities: it is added to them when a third party requires additional confirmation.

In what situations is it requested?

  • terminating a service contract or a commercial lease;
  • closing a business account or line of credit;
  • requesting a refund or cancellation from a supplier;
  • proof for an insurer or a financing body.

What should the declaration contain?

  • the owner's identity and the name of the business;
  • the exact date activities ceased;
  • confirmation that no activity has been carried out since that date;
  • a statement of truthfulness.

What about the sole proprietor declaration?

It does the opposite: it confirms that a person operates a business alone. The two documents can complement each other over the life of a sole proprietorship.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
