Sworn declaration for the Administrative Housing Tribunal: how does it work?

The Administrative Housing Tribunal (Tribunal administratif du logement, TAL) settles disputes between tenants and landlords — unpaid rent, repairs, repossession of a dwelling, among others. In some files, a declaration under oath can support the facts alleged by one of the parties.

As with most tribunals, a declaration received under oath carries more weight for the facts alleged, particularly useful in a file disputed by the other party.

In what situations is it useful?

  • supporting an application related to unpaid rent or repairs not carried out;
  • testifying to the condition of a dwelling at a specific point in time;
  • confirming that notice was served on the other party;
  • presenting evidence by written declaration rather than in-person testimony, when the tribunal allows it.

What should the declaration contain?

  • the declarant's identity and their connection to the file (tenant, landlord, witness);
  • the relevant facts, stated clearly and chronologically;
  • the documents or supporting evidence the declaration refers to;
  • a statement of truthfulness.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
