Sworn cohabitation declaration: when is it needed and how does it work?

Roommates, household members, relatives being housed: some organizations, insurers or landlords ask for a sworn declaration specifying who lives at the same address, since when and in what context, before granting a benefit or processing a request.

Cohabitation is not automatically a common-law union: this declaration describes who lives under the same roof, without legally characterizing the relationship.

In what situations is it requested?

  • an application for aid or a benefit calculated on household composition;
  • home insurance or housing files;
  • a process with an organization that must know a residence's occupants;
  • confirming a shared address for official documents.

What should the declaration contain?

  • the identity of all occupants concerned;
  • the address and the start date of the cohabitation;
  • the nature of the relationship (roommates, family, housing) and how expenses are shared, if useful;
  • a statement of truthfulness.

Cohabitation or common-law union?

If your process aims to prove a couple relationship, it is rather a declaration of common-law union, a document subject to different criteria.
