Sworn rent payment declaration: when is it needed and how does it work?

Rent paid in cash, by transfer to an individual or with no written lease leaves few traces. When payment must be shown, a sworn declaration from the tenant, the landlord or both can supplement other evidence.

Always keep proof of payment (receipts, statements, messages): the sworn declaration is a useful supplement but rarely enough evidence on its own.

In what situations is it requested?

  • proof of residence or solvency required by an organization, institution or immigration authority;
  • a dispute with a landlord over allegedly unpaid rent;
  • a request for aid or a benefit tied to rent paid;
  • no written lease or receipts.

What should the declaration contain?

  • the identity of the tenant and the landlord;
  • the address of the dwelling and the period covered;
  • the amount of rent, the date and method of payments;
  • a statement of truthfulness.

How does this relate to the Tribunal administratif du logement?

If a dispute is brought before the Tribunal administratif du logement, a sworn declaration can serve as evidence in the file.
