Sworn surety or guarantor declaration: how does it work?

Acting as surety means committing to pay another person's debt if they do not. A landlord, lender or supplier may ask the guarantor for a sworn declaration confirming their identity, financial situation and understanding of the commitment.

Suretyship is a serious commitment: the commissioner receives your oath but does not advise you on the scope of your commitment. Read the contract carefully before signing.

In what situations is it requested?

  • renting a home for a student or a newcomer;
  • a personal or mortgage loan guaranteed by a third party;
  • a commercial contract requiring a solvent guarantor;
  • a process where a relative answers financially for you.

What should the declaration contain?

  • the guarantor's full identity and address;
  • identification of the beneficiary of the guarantee and of the debt covered;
  • a description of the guarantor's financial situation, if required;
  • a statement of truthfulness.

How does this relate to the declaration of financial situation?

Often, yes: the creditor wants to be sure the guarantor can actually bear the debt. The declaration of financial situation can then accompany or complete the surety declaration.
