Sworn declaration for a disability benefits application: how does it work?

As part of a disability benefits application — a public plan or private insurance — a sworn declaration may be required to support the circumstances surrounding the incapacity, alongside the usual medical reports.

This declaration never replaces the medical evaluation required by the plan — it supports the file with facts that medical reports alone don't always cover, such as the day-to-day impact of the incapacity.

In what situations is it requested?

  • an initial application for disability benefits, public or private;
  • a review or dispute of a denial decision;
  • confirming the impact of the incapacity on daily or work activities;
  • support from a relative or coworker testifying to the situation.

What should the declaration contain?

  • the declarant's identity and their connection to the person concerned;
  • a precise description of the facts supporting the application;
  • the period concerned;
  • a statement of truthfulness.

Does it need to be sworn?

This depends on the plan concerned. Always check its exact requirements before having your declaration sworn.
