Sworn declaration for an occupational illness: how does it work?

Unlike a workplace accident, an occupational illness often develops over several years — which makes proving it more complex. A sworn declaration can help establish the history of the working conditions or exposure in question, particularly when the employer has changed or coworkers are no longer available to testify.

This declaration can be signed by the worker themselves or by a former coworker able to testify about past working conditions.

In what situations is it useful?

  • establishing the length and nature of exposure to a substance or working condition;
  • confirming working conditions at an employer that no longer exists;
  • supporting a claim disputed by the employer or insurer;
  • completing a file where the coworker witnesses can no longer be reached.

What should the declaration contain?

  • the declarant's identity and their connection to the worker concerned;
  • a precise description of the working conditions or exposure in question;
  • the period concerned;
  • a statement of truthfulness.
