Sworn declaration of assets: in what cases, and how does it work?

Unlike a financial situation declaration, which mostly covers current income and expenses, a declaration of assets provides a complete picture of a person's property and debts at a given point in time — useful in certain family, estate, or judicial proceedings.

This declaration differs from a financial situation declaration in scope: it covers the entire estate of assets and liabilities rather than the ongoing flow of income and expenses.

In what situations is it requested?

  • a family proceeding involving the division of family patrimony;
  • settling an estate requiring a complete inventory;
  • a judicial proceeding where a party's full assets and debts must be established;
  • a notarial process requiring a separate declaration from the inventory.

What should the declaration contain?

  • the declarant's full identity;
  • a list of assets (property, accounts, investments, valuable items);
  • a list of debts and obligations;
  • a statement of the truthfulness and completeness of the information provided.

Does it need to be sworn?

In a judicial or notarial context, a declaration under oath is generally required given the significance of the facts declared. Always check the exact requirements that apply to your process.
