Declaration of source of funds: when is it needed and how does it work?

Under anti-money-laundering rules, financial institutions and some professionals must verify the origin of significant sums. They may ask for a sworn declaration explaining where the funds come from.

The declaration explains the origin of the funds; it does not replace the supporting documents (statements, sale contract, estate deed) that the institution may also require.

In what situations is it requested?

  • a large deposit or transfer into an account;
  • a transaction where the buyer must justify their funds;
  • receiving an inheritance, a gift or sale proceeds;
  • funds arriving from abroad, notably from a newcomer.

What should the declaration contain?

  • your full identity and the amount concerned;
  • the precise source of the funds (savings, sale, inheritance, income, gift);
  • the documents that support this explanation and that you can provide;
  • a statement of truthfulness.

How does this relate to the declaration of assets?

The declaration of assets takes inventory of what you own; the declaration of source of funds explains the origin of a specific sum. The two can complement each other.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
