Consumer declaration: defective product or service not rendered, how does it work?

A defective product, a service paid for but not rendered, a refused warranty: to support a complaint, a refund request or a lawsuit, a sworn declaration fixes the facts, exchanges with the merchant and the harm suffered.

Keep all documents (invoice, contract, exchanges, photos): the sworn declaration supports these documents; it does not replace physical evidence.

In what situations is it requested?

  • a small claims lawsuit or application before a tribunal;
  • a complaint to a consumer protection body;
  • a refund request to a merchant or financial institution;
  • disputing a credit card payment.

What should the declaration contain?

  • your identity and that of the merchant;
  • the description of the product or service, the date and price;
  • the defect observed or non-performance, with dates;
  • the steps already taken with the merchant;
  • a statement of truthfulness.
