Sworn road accident declaration: how does it work?

When disagreement persists over the circumstances of a road accident, your account, in writing and signed under oath, may be requested by an insurer, a lawyer or a court. It fixes your memories while they are fresh.

First report the accident according to the applicable rules (police, insurer, compensation body). This declaration does not replace those steps and does not establish who is responsible for the accident.

In what situations is it requested?

  • a claim with an insurer whose assessment is disputed;
  • civil or administrative proceedings related to the accident;
  • a compensation process for damage or injuries;
  • a situation where your version differs from another party's.

What should the declaration contain?

  • your identity and that of the other people involved, if known;
  • the date, time and place of the accident, and the conditions (weather, lighting, traffic);
  • the sequence of events as you experienced them;
  • the damage and injuries you observed;
  • a statement of truthfulness.

How does this relate to the witness declaration?

If you were not involved but saw the accident, the witness declaration is the appropriate document.
