Sworn witness declaration: when is it needed and how does it work?

Road accident, water damage, altercation, neighbourhood dispute: a witness may be asked to put in writing what they saw or heard. Under oath, this account carries more weight with the insurer, organization or party receiving it.

The commissioner receives your oath as to the accuracy of your declaration: they do not verify the facts or judge the value of your testimony.

In what situations is it requested?

  • an insurance claim following an accident or loss;
  • a civil proceeding where a written statement is useful;
  • a process with a public body or an employer;
  • settling a dispute between neighbours, tenants or partners.

What should the declaration contain?

  • the witness's identity and contact details;
  • the date, time and place of the event;
  • what the witness personally saw or heard, without speculation;
  • a statement of truthfulness.

What should be avoided?

Stick to the facts you observed yourself. Avoid opinions, rumours and legal conclusions: a false or misleading sworn declaration can have serious consequences for its author.
