Declaration relating to a neighbourhood nuisance: how does it work?

A neighbour dispute (repeated noise, smells, encroachment, damage caused by a neighbour) may lead to court action or a complaint to a landlord or municipality. A sworn declaration fixes the observed facts and their frequency.

Describe what you saw or heard with dates and details. Avoid insults, speculation about the neighbour's intentions and legal labels.

In what situations is it requested?

  • a complaint to a landlord or a condominium syndicate;
  • a complaint to a municipality;
  • court action (neighbourhood nuisance, damages);
  • supporting a neighbour's complaint as a witness.

What should the declaration contain?

  • your identity and address;
  • the address and identity of the neighbour concerned, if known;
  • the specific facts (dates, times, duration, nature of the nuisance);
  • the steps already taken (discussion, notice, complaint);
  • a statement of truthfulness.

What if you are only a witness?

A neighbour, tenant or visitor who personally observed the facts can provide a witness declaration separate from that of the person suffering the nuisance.
