Declaration of debt repayment or release: how does it work?

A loan between relatives, or a debt to an individual or small supplier, is often settled without an official receipt. To prove the debt is extinguished, the creditor, the debtor or both may sign a sworn declaration of release.

The creditor attests to having been paid; their declaration counts first. The debtor may also declare having paid, but that proves the debt's extinction less well.

In what situations is it requested?

  • repayment of a loan between relatives;
  • proof to provide to an institution reviewing your credit file;
  • an amicable settlement of a dispute;
  • closing a file during an estate or a sale.

What should the declaration contain?

  • the identity of the creditor and of the debtor;
  • the origin and amount of the debt;
  • the date and method of repayment;
  • a statement that the creditor no longer claims anything under this debt;
  • a statement of truthfulness.

How does this relate to the declaration of financial situation?

An institution reviewing your file may ask for both proof of an extinguished debt and a declaration of financial situation to get a full picture.
