Declaration of non-receipt of a payment or cheque: how does it work?

A cheque lost in the mail, a refund never received, a payment whose trail has gone cold: before issuing a new payment or cancelling the old one, the issuer often requires a sworn declaration confirming that you received and cashed nothing.

The issuer (employer, insurer, organization, individual) sets its own procedure and sometimes a waiting period: ask it first what it requires before drafting your declaration.

In what situations is it requested?

  • a pay, refund or benefit cheque never received;
  • a cheque lost or stolen in the mail;
  • a payment whose cashing is not attributable to you;
  • a request to reissue or stop a payment.

What should the declaration contain?

  • your identity and that of the issuer;
  • the amount, date and number of the payment or cheque, if known;
  • a statement that you neither received, cashed nor endorsed it;
  • the steps already taken (contact with the issuer, your bank);
  • a statement of truthfulness.

What if someone else cashed the cheque?

If a third party cashed the cheque by forging your signature, it is rather a fraudulent endorsement, a case covered in a separate article.
