Declaration of fraudulent cheque endorsement: how to have it sworn?

When a cheque issued in your name has been cashed without your consent — a forged endorsement, a stolen cheque — the financial institution that processed it usually requires a declaration under oath before reimbursing the amount or launching an investigation.

This declaration is a standard banking industry tool: it lets the institution formally document the alleged fraud before starting its own recovery process with the bank that paid the cheque.

In what situations is it requested?

  • a cheque stolen and cashed by another person;
  • a forged endorsement signature;
  • a cheque never received, but which the institution has a record of cashing;
  • fraud discovered during a bank reconciliation.

What should the declaration contain?

  • the declarant's identity and their connection to the cheque (intended payee);
  • details of the cheque concerned (number, amount, date, institution);
  • a statement confirming the declarant did not sign or authorize the endorsement;
  • a statement of truthfulness.

Is a police report also required?

Depending on the financial institution, a police report may be required in addition to the sworn declaration, particularly for large amounts. Check the exact requirements of your institution.
