Declaration relating to a missing or absent person: how does it work?

When a relative has been out of contact for a long time, financial institutions, insurers or organizations may ask for a sworn declaration setting out the known facts: last communication, search efforts undertaken and relationship to the person.

This declaration sets out facts and can never declare a person deceased: only a court can issue a declaratory judgment of absence or death.

In what situations is it requested?

  • urgent management of an account or property when the holder cannot be reached;
  • a process with an insurer or organization when the person cannot be found;
  • supporting an application before a court;
  • informing authorities or an institution about search efforts.

What should the declaration contain?

  • your identity and your relationship to the missing person;
  • the date and circumstances of the last communication;
  • the searches undertaken (relatives, employer, police, hospitals);
  • a statement of truthfulness.

What comes next if the situation continues?

Depending on the situation, steps continue before the courts, possibly with the help of a lawyer or notary. The sworn declaration is only a supporting step.
