Declaration relating to child or spousal support: in what cases, and how does it work?

Whether to confirm regular support payments, declare the amount to an organization, or attest to an agreement between former spouses not yet homologated by the court, a sworn declaration may be required when the usual documents (judgment, bank statements) are not enough on their own.

This declaration never replaces a support judgment or a homologated agreement — it confirms an already-established situation, for an organization that requires this specific form of document.

In what situations is it requested?

  • confirming regular payment or receipt of support for a benefit or credit application;
  • attesting to an informal agreement between former spouses, in the absence of a judgment;
  • supporting an income declaration where support payments have a tax effect;
  • confirming the absence of support paid or received, if applicable.

What should the declaration contain?

  • the identity of both former spouses and the child concerned, if applicable;
  • the amount and frequency of payments;
  • a reference to the judgment or agreement, if applicable;
  • a statement of truthfulness.

Does it need to be sworn?

This depends on the receiving organization. Always check its exact requirements before having your declaration sworn.
