Declaration relating to workplace harassment: how does it work?

A person who experiences or observes harassment at work may want to record the facts in writing and under oath, notably to support a complaint to the employer, an organization or a tribunal.

This declaration records facts; it does not legally characterize the situation and does not replace a formal complaint or the advice of a lawyer or specialized organization.

In what situations is it requested?

  • a complaint to the employer or an internal body;
  • a recourse before an organization or a tribunal;
  • a claim tied to an occupational health and safety file;
  • supporting a colleague's complaint as a witness.

What should the declaration contain?

  • your identity and your connection to the company;
  • a factual description of the events (dates, places, people present, specific words or acts);
  • the steps already taken (report, complaint, notice);
  • a statement of truthfulness.
