Sworn declaration for a CNESST file: how does it work?

In some files handled by the Commission des normes, de l'équité, de la santé et de la sécurité du travail (CNESST) — a claim for a workplace accident, an occupational illness, or a dispute — a declaration under oath may be requested to support the facts alleged.

In a disputed file, a declaration received under oath carries more weight, since the declarant formally confirms the truthfulness of the facts before an authorized person.

In what situations is a declaration under oath useful?

  • describing the circumstances of a workplace accident;
  • testifying to working conditions related to an occupational illness;
  • supporting a dispute before the Tribunal administratif du travail;
  • confirming facts as a coworker or witness to the event.

Who can sign a declaration in this context?

The worker concerned, a witness to the event, or any other person who can confirm facts relevant to the file.

Does CNESST always require a declaration under oath?

No. It depends on the file, how far it has progressed — initial claim, review, dispute — and what exactly the officer or tribunal requests. Always check what is required in your specific file.

What should the declaration contain?

  • the declarant's identity and their connection to the file;
  • a precise, chronological description of the facts;
  • a statement of the truthfulness of the information provided.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
