When a workplace accident is disputed or the circumstances are unclear, the written testimony of a coworker present at the time can significantly support the injured worker's file — especially when received under oath.

This declaration is distinct from the injured worker's own declaration — it corroborates or clarifies the facts from the point of view of a person present on the scene.

In what situations is it useful?

  • the accident is disputed by the employer or insurer;
  • no other material evidence of the event (camera, incident report) is available;
  • clarifying the exact circumstances for the Tribunal administratif du travail;
  • supporting the initial claim or a file review.

What should the declaration contain?

  • the witness's identity and their connection to the injured worker (coworker, supervisor);
  • a precise, chronological description of what was observed;
  • the witness's position at the time of the event (proximity, line of sight);
  • a statement of truthfulness.

Does CNESST always require a witness declaration?

No — it depends on the file and the level of evidence already available. Check what is required in the specific file concerned before having the declaration sworn.
