Sworn child custody declaration: in what cases, and how does it work?

When a parent must demonstrate their child's custody arrangements — to a school, an organization, a foreign authority — and the judgment or parenting agreement alone is not enough to meet the request, a declaration under oath can be used to clarify the situation.

This declaration never replaces a custody judgment or a homologated parenting agreement — it instead summarizes or confirms an already-established situation, for an organization that requires this specific form of document.

In what situations is it requested?

  • school registration or a change of school;
  • a child travelling with a single parent, alongside a parental travel authorization;
  • a process with an organization that does not accept the custody judgment as-is;
  • confirming custody arrangements for a foreign authority.

What should the declaration contain?

  • the declaring parent's identity and the child's identity;
  • a summary of the custody arrangements (sole custody, shared custody, access rights);
  • a reference to the judgment or parenting agreement, if applicable;
  • a statement of truthfulness.

Does it need to be sworn?

This depends on the receiving organization. Always check its exact requirements before having your declaration sworn.
