Sworn declaration for an insurance claim: how does it work?

As part of an insurance claim — a car accident, home damage, or lost or stolen property — an insurer may require a declaration under oath detailing the circumstances of the event, in addition to the usual claim form.

A declaration under oath gives more weight to the facts alleged in a claim, which can speed up its processing — or become necessary when the insurer suspects an anomaly and requires formal confirmation before paying.

In what situations is it requested?

  • an auto insurance claim following an accident or theft;
  • a home insurance claim following damage (water damage, fire, theft);
  • loss or theft of covered property, with no other witness to the event;
  • a disputed claim where the insurer requires additional confirmation.

What should the declaration contain?

  • the declarant's identity and policy number;
  • a precise, chronological description of the event;
  • a list of the property or damage concerned, with estimated value;
  • a statement of truthfulness.

Does the insurer always require a declaration under oath?

No — it depends on the nature and value of the claim, as well as the insurer's practices. Always check the exact requirements stated in your policy or by your agent.
