Declaration relating to a non-profit organization (NPO): how does it work?

A director, officer or founding member of an NPO may be asked to declare under oath their role, the nature of the organization's activities or its non-profit status, notably for a grant, opening a bank account or a contract.

This declaration does not create the organization and does not replace its constituting documents or official registration: it confirms facts at a third party's request.

In what situations is it requested?

  • a grant or financial aid application;
  • opening a bank account in the organization's name;
  • entering into a lease or a contract with a supplier;
  • proof of a director or officer position.

What should the declaration contain?

  • your identity and your role within the organization;
  • the name of the organization and, if applicable, its registration number;
  • the nature of the activities and the non-profit status;
  • the specific facts the declaration is meant to confirm;
  • a statement of truthfulness.

How does this relate to business declarations?

For a for-profit business, notably a sole proprietorship, see rather our article on the sole proprietor declaration.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
