Declaration of an unauthorized transaction (card or account): how does it work?

When a transaction you did not authorize appears on your credit card or account, the financial institution may require a sworn declaration describing the facts before refunding or opening an investigation.

Contact your financial institution first to block the card and report the transaction: the sworn declaration comes afterwards, if required, and does not replace that immediate report.

In what situations is it requested?

  • online or in-store purchases you did not make;
  • a card copied, lost or stolen and then used fraudulently;
  • a withdrawal or transfer you do not recognize;
  • disputing an amount after the ordinary reporting period has ended.

What should the declaration contain?

  • your identity and the account or card number concerned (partially masked);
  • the list of disputed transactions with dates and amounts;
  • the known circumstances (lost card, suspicious email, etc.) and the date you discovered the fraud;
  • a statement that you neither made nor authorized these transactions;
  • a statement of truthfulness.

How does this relate to fraudulent cheques?

The principle is close: in both cases, you swear that you did not authorize a transaction. For a cheque endorsed by a third party, see our dedicated article.

Can it be sworn online?

Yes, when the document and situation are eligible for remote oath commissioning, by videoconference.
