Form PWGSC-TPSGC 2016 is used to declare the existence of a common-law relationship under the Public Service Superannuation Act. The declarant states that they live in a common-law relationship with a named person and enters the period of cohabitation.
The declaration is signed before a Commissioner of Oaths, a notary public or a justice of the peace, as indicated on the form. It should not be confused with form CF-FC 2016, which covers the Canadian Armed Forces pension plan.
The oath, in brief
Form PWGSC-TPSGC 2016 contains a declaration under oath or a solemn declaration: it must be signed before a person legally authorized to receive it — a Commissioner for Oaths, notary, lawyer, or justice of the peace. Once sworn, the declaration has the same weight as a statement made before a court.
In Québec, a Commissioner for Oaths can administer this oath remotely, by videoconference, when the required conditions are met (seeing and hearing each other, viewing the document, keeping it confidential).
